These terms govern the supply of goods by Hard Hardware Pty Ltd (ABN 59 696 358 764) to you.
Placing an order means you accept them. Any terms on your purchase order that conflict with these
terms do not apply unless we agree to them in writing. Trade account holders should also read our
trade account terms, which apply in addition to these.
1. Quotes and pricing
- Quotes are valid for 28 days from the date of issue unless stated otherwise on the quote.
- Prices are in Australian dollars and exclude GST. GST is added at the prevailing rate on the tax invoice.
- Prices are ex-works our Park Ridge premises. Freight is quoted separately — see section 5.
- Quoted prices are based on the quantities, sizes, finishes and pack quantities specified. Changing any of them may change the price.
- Catalogue and website prices, where shown, are indicative. The price on your accepted quote or order confirmation is the price that applies.
2. Orders
- An order is accepted when we issue an order confirmation or dispatch the goods, whichever happens first.
- Products are supplied in the pack quantities listed in the current catalogue edition.
- Special order and indent goods are made or imported for you. They require a 50% deposit, which is non-refundable, with the balance payable before dispatch. Once we have confirmed the order with our supplier it cannot be cancelled.
- Stock orders may be cancelled before dispatch at no charge. After dispatch, section 7 applies.
3. Payment
- Approved account customers: 30 days from the date of invoice.
- Cash on delivery (COD): available to registered buyers. Payment is due on site at delivery and must clear within 7 days of delivery. Orders above a certain size or delivery distance* are quoted with freight before we confirm them.
- Customers without an account: payment in full in cleared funds before dispatch.
- Methods: EFT or bank transfer, card, and cash on COD deliveries. A card surcharge equal to our processing cost may apply on some card types; we tell you before you pay.
- Overdue amounts carry interest at 14% per annum, and all costs of recovery, including collection agency and legal costs, are charged to the account.
- Credit limits are set at our discretion and may be varied or withdrawn at any time.
* The size and distance thresholds for COD are set by Hard Hardware and are
disclosed to you at the time of quoting.
4. Dispatch
- Stock items: 1 – 2 business days from receipt of a confirmed, payable order.
- Indent orders: 8 – 12 weeks, confirmed per order.
- Collection from Park Ridge: by appointment, Monday to Friday, with a minimum of 2 hours' notice.
- Dispatch times are estimates given in good faith and are not delivery times.
5. Freight and delivery
| Destination | Order value | Freight |
| Within 50 km of Brisbane | Over $150 ex GST | Free |
| Within 230 km of Brisbane | Over $350 ex GST | Free |
| Beyond 230 km, or under those thresholds | Any | Quoted per order |
6. Title and risk
- Risk in the goods passes to you on delivery to you or to your carrier, whichever occurs first.
- Title does not pass until we have received payment in full for those goods and all other amounts you owe us. Until then you hold the goods as bailee, must keep them identifiable and separately stored, and we may enter your premises to recover them. These terms create a security interest for the purposes of the Personal Property Securities Act 2009 (Cth) and we may register it on the PPSR.
- You must notify us of shortages, incorrect goods or transit damage within 48 hours of delivery, in writing, with photographs. Claims made after that period may not be accepted by us or by the carrier.
7. Returns
- Change of mind: accepted within 14 days of invoice, where the goods are unused, in their original unopened packaging, and resaleable. A 20% restocking fee applies.
- Not returnable: special order and indent goods, goods cut or modified to your requirement, and clearance lines.
- Return freight is at your cost on a change-of-mind return. We pay return freight where the goods are faulty or we have made an error.
- Request a return authority before sending anything back.
8. Warranty
We warrant that goods are free from manufacturing defects for 12 months from the date
of invoice. The warranty does not cover fair wear and tear, misuse, corrosion arising from use of the
wrong grade for the environment, or faults arising from installation. Where a failure is not a major
failure, our remedy is to repair, replace or refund at our election. The guarantees
under the Australian Consumer Law apply in addition to this warranty.
9. Product selection
- You are responsible for selecting the grade, size, finish and standard appropriate to your application, including load, substrate, exposure and any building code or standard that applies. We supply to the specification stated.
- If you are unsure, ask us or consult an engineer before ordering.
- Dimensions are nominal and subject to normal manufacturing tolerances. Finish, colour and plating may vary between production batches. For finish-critical work, order the full quantity in one batch and request a sample first.
- Certifications shown in our catalogues are held by our manufacturing partner. Mill or test certificates are available on request, at cost where they are not routinely held.
10. Australian Consumer Law
Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have
under the Competition and Consumer Act 2010 (Cth), including the consumer guarantees in the
Australian Consumer Law, where to do so would be unlawful.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. For
major failures you are entitled to a replacement or refund, and to compensation for any other
reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced
if they are not of acceptable quality and the failure does not amount to a major failure.
11. Limitation of liability
Subject to section 10, our total liability arising out of or in connection with the supply of
goods is limited to the invoice value of the goods giving rise to the claim. We are not liable for
indirect or consequential loss, loss of profit, loss of contract, site delay costs, or the cost of
removing or reinstating goods, however caused.
12. Intellectual property
The Hard Hardware name, wordmark, catalogues, product codes, photography and website content are
our property. You may download and share our catalogues in unaltered form for the purpose of
specifying and buying our products. Any other reproduction, or use of our name or codes to market
goods that are not ours, requires our written consent.
13. Force majeure
We are not liable for failure or delay in performance caused by events beyond our reasonable
control, including port strikes and shipping disruption, customs delays, supplier failure,
industrial action, extreme weather and flooding, and government action.
14. Privacy
Personal information you give us is handled in accordance with our
privacy policy.
15. General
- These terms are governed by the laws of Queensland, Australia, and the parties submit to the jurisdiction of the courts of that State.
- If any provision is unenforceable, it is severed and the rest continues to apply.
- We may vary these terms by publishing an updated version at this address. The version current at the date of your order applies to that order.
- You may not assign your rights under these terms without our written consent.
